With the 'Ordinance of the President of the Regional Council n. 105 of 02 October 2020, "Urgent measures regarding the containment and management of the epidemiological emergency from the COVID-19 virus ", the Veneto Region proposes a screening activity for SARS-CoV-2 within schools by means of a rapid response rhino-pharyngeal swab.
Within this document an authorization form entitled "informed consent" is proposed in which a prior authorization is requested, without actually giving no real information, as you can see:
Following countless requests for advice in this regard, we are publishing a possible answer to be given to the school which will propose it, as per the ordinance, to parents and which can be used in case you don't want to authorize the school for this type of activity on the minor or if, rightly, you want to have a true informed consent.
We make it available to you below as a starting point or outline, both in PDF and editable Word.
We, the association for freedom of choice, do not enter into the specific merits of screening tests, even if we have some doubts, but we believe that there are rights that we cannot derogate.
Recall that the Law 22 December 2017, n. 219, "Rules on informed consent and advance processing provisions", entered into force in January 2018, provides for specific requirements regarding informed consent. To Art. 1 you can clearly read that "This law, in compliance with the principles set out in articles 2, 13 and 32 of the Constitution and articles 1, 2 and 3 of the Charter of Fundamental Rights of the European Union, protects the right to life, health and dignity and the self-determination of the person and establishes that no health treatment can be started or continued without the free and informed consent of the person concerned, except in cases expressly provided for by law.
